Important Information Regarding Married Persons on Waiver Programs
On March 1, 2016 the Minnesota Department of Human Services sent a letter to enrollees receiving Medical Assistance (MA) services through various Home and Community-Based Services (HCBS) waiver programs. The letter informed recipients of potential 2017 changes tied to spousal impoverishment rules knows as “anti-spousal-impoverishment protections.” If these changes were to take place, they would affect how eligibility for MA is determined for married couples. (Enrollees may have also received a letter from their county of financial responsibility.)
If you received a letter and have questions, please contact us today. In addition, we ve created a resource page for those wanting more information regarding the potential law change. You’ll find background information on the potential changes, as well as information on who is — and who is not — affected, compliance deadlines, common mistakes in interpreting spousal impoverishment rules and more. Most importantly, you’ll find a recommendation to contact an elder law attorney who can help you navigate the spousal impoverishment rules and develop a plan that best suits your needs. County, state or government agencies can provide general guidance, but are not always able to provide the best legal advice. Our attorneys are experienced special needs and elder law attorneys, and can provide you with accurate and timely guidance.
We believe the best way to prepare for the future is to be equipped with information today. At Long, Reher, Hanson Price we’d like to come speak to your group or organization about Elder Care issues you face now or may encounter in the future.
